09:00 12:00 Copyright Committee

Platforms, tools and copyright authorization – when do acts of facilitation become secondary copyright infringement?

Copying is easier than ever, thanks to rapid distribution tools such as the Internet, and the digitisation of copyright works. This has given rise to businesses which may be seen to assist or facilitate copyright infringement. Such businesses include Google, Dropbox and Bittorrent, Inc. Many of these businesses provide tools that may be used for legitimate purposes. To what extent, if any, are these platforms/tools providers liable for copyright infringement that occurs using those tools/platforms? If they are liable, to what extent should they be liable— will knowledge of the infringement and/or financial benefit to these platforms/tool providers contribute to a finding of liability?

09:00 12:00 Trademarks Committee

Registration and Use of Parody Trademarks

Traditionally, trademark parody has been often used as a defense against trademark infringement and/or unfair competition. However, nowadays, even some luxury brands market fake-like limited collections, parodying their own brands. As such, the boundaries between trademark parody and infringement are gradually being blurred and becoming a more complex issue. In that sense, it would be meaningful to compare and contrast how trademark parody is treated in each jurisdiction including related legal issues
